What a "Croc"

I just read an article in the local newspaper about someone suing the maker of the popular clogs shoes as a result of an injury that occured when their shoe became trapped in an escalator. Granted, I don't know all the details, and I sympathize with the injured party, but whatever happened to "it was just an accident" as an explanation?
 
Its the modern way. Never an accident. SOMEONE always at fault, and its NEVER the victim. Too many lawyers, for the legitimate legal work, so they have to find work. Ed
 
it is getting out of hand. here in atlanta, i pull a banner for a law firm. they do not want us to fly there banner over rush hr traffic b/c they are worried about someone getting in a wreck while looking at the banner and getting a lawsuit on them.
 
The'll win too the manufacturers have a special account that they just pay out of for this. They also pay for elevator accidents too. How do i know about this? I worked for a company.
 
Ever wondered why a cup of coffee from McDonalds says" CAUTION HOT". Because some yahoo spilled the coffee on them, got burned, sued MCD's and won the lawsuit. Last time I checked, anyone with common sense knows coffee is hot (well real coffee is hot :lol: ). Just another thing to make a buck off of.

One radio talk show hosts team members' son, wearing Croc's, had his foot caught up in an escalator. This happened in Atlanta, GA. From the discussion, apparently Croc's getting caught is more than a rare isolated incident.

Do I think the accidents are all the manufacturer's fault. No. Part of the blame does reside with the accident victum(s).

We do need to change the law. In that the looser of a law suit pays, not only for his attorney fees, but the court costs and the oppositions costs.
 
If I remember right the McDonalds issue was a cost savings issue. The company used less coffee grounds and increased the temperature so it was so hot you tell it was weak coffee. I guess all the savings on the coffee grounds was lost in the settlement. Russ
 
It's a sad commentary on our current society. :(

Wait till they get done with lawsuits over the Wal-Mart employee killed in New York state. They have already filed suit against just about everybody in the phone book.
 
Crocs are great :!: I love em... and for antenuating the affects of peripheral neuropathy, which is am plaqued with, the little bumps and the form of the inner sole reduces the pain associated with PN. However, there is a time and a place to wear Crocs... there is also a bit of common sense that needs to be used when wearing them.

I wear em a lot, but try to limit their use to low risk situations, as they are not designed for all situations.

Em slipped and hurt herself this summer in the hospital, and yes she was wearing the thong style croc and it doesn't do well on uneven surfaces.. you can sometimes trigger a fall. Crocs don't much like slippery surfaces either.

But you know what? Common sense and responsibility for our choices lies with each of us. We do not abrogate our own responsiblities and place them at the feet of the entities that provide us with the things we demand. We demand these products so companies provide them. They provide something in response to marketplace demands. Unfortunately in today's society, it seems that people demand a product,that it will last forever, that it is cheap, that it is easy to use and then we expect the manufacturer to assume all liability associated with that product including our one stupidity in the use of the product. Product Liability and Responsibility are simialr but decidedly different subjects of obligation.

Personally I think that responsibility is in the realm of the purchaser for how it is used. Responsiblity for quality, fit, finish and structural integrity as well as the instructions on proper use, care and situational safety are in the realm of the manufacturer. Takes two to tango.. and we all need to be aware of our own basic reponsibilities.
 
Messed up on my first reply so I will do it over. What is sad is that cases juch as these even make it to court, and when they do, the jury rules in their favor. People don't have to take responsibily anymore for their own actions.
